Introduction
Welcome to CoverCare Insurance Inc. These Terms and Conditions (“Terms,” “Agreement”) govern your access to and use of the CoverCare Insurance Inc. website, mobile applications, and related services (collectively, the “Site” or “Services”). By accessing or using our Site, you agree to be bound by these Terms and our Privacy Policy.
PLEASE READ THESE TERMS CAREFULLY. BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE OUR SERVICES.
1. Description of Services
CoverCare Insurance Inc. is a health and life insurance platform that provides educational resources, comparison tools, and services designed to help you find insurance coverage and obtain insurance quotes. These insurance products and services are provided by third-party insurance companies, carriers, and providers (collectively referred to as “Insurers” or “Insurance Providers”). Insurance Providers include licensed insurance companies, our marketing partners, brokers, agents, and other intermediaries authorized to offer insurance products.
Important: CoverCare Insurance Inc. is an insurance agency staffed by licensed insurance agents who are contracted with multiple insurance carriers. While we are not an insurance company or underwriter, our licensed agents work directly with you to assess your insurance needs, provide quotes, and help you enroll in insurance policies offered by third-party insurance carriers such as Humana, UnitedHealthcare, and other leading insurance companies. The insurance carriers make final coverage decisions and issue policies, but our licensed agents serve as your point of contact throughout the sales and enrollment process.
1.1 How Our Services Work
When you complete a quote request or submit your information through our Site, you may:
- Be contacted by our licensed insurance agents who will discuss your insurance needs, provide personalized quotes from multiple carriers, and help you compare coverage options
- Receive contact from CoverCare’s licensed agents via phone, email, SMS, or mail to discuss insurance options and assist with enrollment
- Receive personalized recommendations from our agents regarding insurance carriers and plans that best match your needs and budget
- Receive educational content, comparisons, and tools to help you make informed insurance decisions
Please Note: Our licensed agents will work with you to gather the necessary information for accurate quotes. While we strive to find you the best coverage options, there is no guarantee that you will qualify for any particular insurance product or premium rate. Final coverage decisions, underwriting, and pricing are determined by the insurance carriers based on their underwriting criteria. Our agents represent you in working with carriers but cannot override carrier underwriting decisions.
1.2 Our Compensation Model
CoverCare Insurance Inc. receives compensation from Insurance Providers in our network. We may be compensated when:
- We display advertisements or promotional content for Insurance Provider products
- You submit a quote request or application through our Site
- You are matched with an Insurance Provider
- You respond to an offer or quote from an Insurance Provider
- You enroll in an insurance policy with the assistance of our licensed agents (we receive commissions from the insurance carriers)
As licensed insurance agents, we receive commissions from the insurance carriers when you enroll in a policy. This commission-based compensation structure allows us to provide our services to you at no additional charge—you pay the same premium whether you work with us or go directly to the carrier. Commission rates may vary by carrier and product type. By using our Services, you acknowledge and consent to this compensation arrangement and understand that our agents are contracted with specific carriers, which may influence the options we can offer.
1.3 No Endorsement or Recommendation
While our licensed agents will provide professional recommendations based on your needs and circumstances, CoverCare Insurance Inc. does not guarantee specific coverage outcomes or pricing, as these are determined by the insurance carriers. Our agents act as your representatives in helping you navigate insurance options and enroll in coverage. However, you are ultimately responsible for reviewing policy terms, understanding coverage details, and making informed decisions about which insurance products best meet your needs.
2. Acceptance of Terms
By accessing or using our Site or Services, you represent and warrant that:
- You are at least 18 years of age (or the age of majority in your jurisdiction)
- You have the legal capacity to enter into a binding agreement
- All information you provide is accurate, current, and complete
- You will comply with all applicable laws and regulations
- You have read and agree to these Terms and our Privacy Policy
3. User Accounts and Registration
To access certain features of our Services, you may be required to register for an account. When creating an account, you agree to:

Your use of CoverCare Insurance Inc.’s Services is subject to our Privacy Policy, which describes how we collect, use, share, and protect your personal information. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.
Data Sharing with Insurance Providers: When you submit a quote request or application, you expressly authorize us to share your information with Insurance Providers in our network so they can provide you with quotes, offers, and information about their insurance products. This may include personal information, health information, and financial information necessary for insurance underwriting and enrollment.
5. Electronic Communications and Consent
By using our Site or Services, you consent to receive electronic communications from CoverCare Insurance Inc., our licensed agents, and from insurance carriers with whom we are contracted. Electronic communications include:
- Email messages about your quotes, applications, and account
- SMS text messages with insurance offers, quotes, and updates
- Phone calls from our licensed agents to discuss insurance options and assist with enrollment
- Marketing communications about insurance products and services
- Administrative notices, disclosures, and legal communications
You agree that all electronic communications satisfy any legal requirement that such communications be in writing. You may opt out of marketing communications at any time by following the unsubscribe instructions provided in those communications.
5.1 Telephone Consumer Protection Act (TCPA) Consent
By providing your telephone number, you expressly consent to receive calls and text messages from CoverCare Insurance Inc., our licensed agents, and insurance carriers we represent, using automated telephone dialing systems, artificial or prerecorded voices, and text messages regarding insurance products, quotes, enrollment assistance, and related services. You understand that your consent is not required as a condition of purchasing any goods or services. Standard message and data rates may apply. You may revoke this consent at any time by contacting us or replying STOP to text messages. Consent is provided where required by applicable law, and you may revoke your consent at any time using the methods described above.
6. Minors and Parental Consent
Our Services are intended for individuals who are at least 18 years of age. We may collect information about minors in limited circumstances, including:
- When a minor is listed as a dependent on a parent’s or guardian’s insurance policy
- For beneficiary designation purposes
- To determine eligibility for family coverage plans
- As required by law or regulation
If you are under 18 years of age, you may only use our Services with the permission and supervision of a parent or legal guardian. Parents and guardians are responsible for the actions of minors using our Services.
7. Prohibited Uses and Conduct
You agree not to use our Site or Services for any unlawful purpose or in any way that violates these Terms. Prohibited activities include, but are not limited to:
- Providing false, inaccurate, or misleading information
- Impersonating another person or entity
- Engaging in fraudulent activities or insurance fraud

8. Intellectual Property Rights
All content on the Site, including but not limited to text, graphics, logos, images, audio, video, and software, and the compilation thereof (“Content”), is owned by or licensed to CoverCare Insurance Inc., and is protected by United States and international copyright, trademark, and other applicable intellectual property laws. Except as expressly stated otherwise, all rights in the Content are reserved. Third-party content and software are subject to their respective licenses.
8.1 Limited License
Subject to your compliance with these Terms, CoverCare grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Site and Services for personal, non-commercial purposes. This license does not include the right to:
- Modify, copy, distribute, transmit, display, perform, reproduce, or create derivative works from our Content
- Reverse engineer, decompile, or disassemble any software or technology
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
- Use our Content for commercial purposes or resale
- Frame, mirror, or otherwise incorporate our Content into another website
All trademarks, service marks, and trade names used on the Site are the property of their respective owners. You do not acquire any ownership rights in any Content through your use of the Services.

10. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. COVERCARE INSURANCE INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
- WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
- WARRANTIES REGARDING THE QUALITY OR SUITABILITY OF INSURANCE PRODUCTS
- WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED
We make no representations or warranties about the insurance quotes, offers, or products provided by Insurance Providers. You acknowledge that insurance coverage decisions, underwriting, and pricing are made solely by Insurance Providers based on their own criteria and policies.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COVERCARE INSURANCE INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO:
- YOUR USE OR INABILITY TO USE THE SITE OR SERVICES
- ANY ERRORS, INACCURACIES, OR OMISSIONS IN CONTENT
- INSURANCE QUOTES, OFFERS, OR COVERAGE DECISIONS
- UNAUTHORIZED ACCESS TO YOUR PERSONAL INFORMATION
- INTERRUPTION OR CESSATION OF SERVICES
- THE CONDUCT OR CONTENT OF THIRD PARTIES
- ANY OTHER MATTER RELATING TO THE SERVICES
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
12. Indemnification
You agree to indemnify, defend, and hold harmless CoverCare Insurance Inc., its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or relating to: (a) your use or misuse of the Site or Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights or privacy rights; (d) your violation of any applicable laws or regulations; or (e) any false, inaccurate, or misleading information you provide. CoverCare reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate fully with our defense of such claims.
13. Dispute Resolution and Arbitration
13.1 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and CoverCare Insurance Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
The arbitration will be conducted by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
13.2 Arbitration Procedures
The arbitration will be conducted by a single neutral arbitrator in a location mutually agreed upon by the parties, or if no agreement can be reached, in a location determined by the AAA. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction.
13.3 Class Action Waiver
YOU AND COVERCARE AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND COVERCARE EXPRESSLY WAIVE ANY RIGHT TO FILE A CLASS ACTION OR SEEK RELIEF ON A CLASS BASIS.
You may only bring claims against CoverCare in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
13.4 Exceptions to Arbitration
Either party may seek injunctive or other equitable relief in court to protect intellectual property rights or confidential information. Additionally, either party may bring an individual action in small claims court for disputes within its jurisdiction.
13.5 Arbitration Opt-Out
You may opt out of this arbitration agreement by providing written notice to CoverCare Insurance Inc. within thirty (30) days of first accepting these Terms. Your notice must include your name, contact information, and a clear statement that you wish to opt out of arbitration. If you opt out, neither party will be bound by the arbitration provisions.
14. Termination and Suspension
CoverCare Insurance Inc. reserves the right, in its sole discretion, to:
- Terminate or suspend your access to the Site or Services at any time, with or without notice
- Refuse service to anyone for any lawful reason
- Modify, suspend, or discontinue the Site or Services
- Delete or disable content or features
We may terminate your access immediately if you violate these Terms or engage in fraudulent, illegal, or harmful activities. Upon termination, all provisions of these Terms that by their nature should survive will remain in effect, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
15. Modifications to Terms
CoverCare Insurance Inc. reserves the right to modify these Terms at any time. When we make material changes, we will:
- Post the updated Terms on our Site with a new effective date
- Notify you by email or through a prominent notice on our Site
- Provide you with an opportunity to review the changes
Your continued use of the Site or Services after the effective date of the modified Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using our Services.
16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Subject to the arbitration provisions above, you agree to submit to the personal jurisdiction of the state and federal courts located in Broward County, Florida for any actions not subject to arbitration.
17. International Users
Our Services are controlled and operated from the United States. If you access our Services from outside the United States, you do so at your own risk and are responsible for compliance with all applicable local laws and regulations. We make no representation that our Services are appropriate or available for use outside the United States.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.
19. Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
20. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published on our Site, constitute the entire agreement between you and CoverCare Insurance Inc. regarding your use of the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.
